As crianças invisíveis: O regime de proteção à utilização de crianças nas forças armadas do Lord’s Resistance Army

O presente artigo busca mensurar a efetividade dos regimes internacionais, segundo as dimensões de Oran Young, e suas respectivas instituições no que tange a proteção das crianças em conflitos armados, tomando como base o recrutamento forçado de crianças pelo Lord’s Resistance Army. Seu objetivo foi verificar se desde a aplicação da Convenção dos Direitos da Criança (CDC) e o Protocolo Opcional sobre o Envolvimento de Crianças em Conflitos Armados houveram avanços em termos da proteção das chamadas crianças soldados, tendo vista que as abduções continuam a ser recorrentes no dado território. A pesquisa investigou a efetividade do regime e a forma de implementação de um regimento internacional no território de Uganda. Os resultados mostram que, em consonância ao que se era esperado, verificou-se uma inefetividade do Estado em implementar a proteção às crianças da abdução pelo Lord’s Resistance Army, conforme previsto no artigo 38 da Convenção dos Direitos da Criança (CDC) e do Protocolo Facultativo. Verificou-se, entretanto, que a cooperação internacional vem gerando avanços positivos na transposição das normas e regras ratificadas pelo governo de Uganda do âmbito internacional para o âmbito doméstico.

ABSTRACT

This paper conducted a study, which sought to measure the effectiveness of the international regimes and its institutions, regarding the protection of children in armed conflicts, considering Oran Young’s dimensions of effectiveness. The article evaluated this dimensions considering the child recruiting practiced by the Lord’s Resistance Army, in the Northeast of Uganda. The paper aimed to determine, after the implementation of the Child Rights Convention (CRC) and the Optional Protocol on the Involvement of Children in Armed Conflict, if there were any development in terms of the protection of the so-called child soldiers. The research investigated the effectiveness of the system and the way of implementing an international regime on the territory of Uganda. The results showed, as expected, that the State was ineffective in enforcing the protection of children from the abduction by the Lord’s Resistance Army, as stated in Article 38 of the Convention on the Rights of the Child and the Optional Protocol. It was found, however, that international cooperation has generated positive developments in the implementation of the norms and rules ratified by the government of Uganda under the international to the domestic sphere.
