Rule of law and rule by law: case analysis of foreign investment in Guangdong and Jiangsu (China)

Resumo

¿Por qué provincias similares tienen distinta estabilidad en sus flujos de inversión extranjera? La investigación compara las provincias de Guangdong y Jiangsu en la República Popular China y discute porqué estas provincias de similares características en infraestructura e incentivos bajo el modelo de apertura chino se diferencian en la estabilidad de los flujos de Inversión Extranjera Directa (IED). La hipótesis se centró en que la agenda legal en materia de inversión extranjera presenta un punto de equilibrio más cercano al rule of law en Guangdong que en Jiangsu. La investigación desarrolla una definición teórica sobre el punto de equilibrio entre rule of law y rule by law en China y contrasta empíricamente, con técnicas de minería de texto y procesamiento de lenguaje natural, la agenda legal en materia de inversiones en las mencionadas dos provincias. Como conclusión, la hipótesis se comprueba pero con el hallazgo emergente del factor cultural en la Provincia de Guangdong. Es justamente este emergente el que permite discutir el poder explicativo del rule of law sobre la estabilidad de los flujos de IED.
