What is the source of human rights legitimacy for conflict resolution and the creation of solidarity bonds? If, on the one hand, they are an important means of guaranteeing the basic freedoms of all men and citizens, on the other hand, they are characteristic of Western political tradition, but specifically of that tradition of European origin. The idea that they are natural rights and, therefore, cannot be refuted, creates the conception that they should be imposed on other cultures. But how can we compel a people of a another culture, who does not recognize human rights, to accept them? How to resolve conflicts involving different cultural (and religious) traditions, based on human rights? Habermas can help us answer these questions with his model of deliberative democracy and his procedural theory of law.
