The crisis of the function in the inverse disregard of legal personality: analysis in the light of the theory of the Double Crisis of Legal Personality

The legal personality, discussed over time, by renowned authors, with the help of theories that seek the correct definition and application of the Institute, apparently, remains pacified both in its concept and in its application. With specific procedures, adopted by the Brazilian legal system, there is a glimpse of the recent decisions of the Courts, regarding the disregard of the reverse legal personality, which express non-compliance with the pacification of the doctrine on the subject. The distorted hermeneutics, present in the use of Art. 50 of the Brazilian Civil Code (CCB), which deals with the disregard of legal personality, is evident. The aforementioned Art. receives support from the theory of José Lamartine Corrêa de Oliveira, who focuses on the study of legal personality and its crises, in particular on the crisis of function, and Pontes de Miranda, who deals with demonstrating legal personality as a fact, not as a fiction. Throughout this article, the theory of legal personality will be analyzed in detail, through the authors Caio Mário da Silva Pereira and Maria Helena Diniz, as well as the non-compliance of the judiciary, with regard to the concept of legal entity, through the jurisprudence of the Court of Justice of Minas Gerais and Superior Courts of Justice. Using doctrinal and jurisprudential research, we seek to make a parallel between theory and reality, with the aim of showing that, contrary to common sense and automated practices, the topic of legal personality, nowadays, is not pacified, as well how to encourage such a discussion to be resumed by researchers.
