This article addresses the alteration of consciense caused by drugs. It is expected to demonstrate the connection that exists between perception, senses, reasoning and narcotic substances. We will also see the relationship with the legal aspect, to the extent that human beings have a conscience that holds them responsible for your actions, since they have the ability to analyze themselves. Hence culpability depends on three simultaneous elements: the potential for anti-legal awareness; the demand for different conduct; and imputability (or subject capacity). Therefore, when the agent is in a state of altered consciousness, should he be held responsible for his actions? Therefore, it is necessary for the State to prove the guilt of the agent, who is constitutionally presumed innocent. Thatwith, no crime or penalty will be imputed unless the criminal conduct is disapproved in a lato sensu judgment of guilt. The theory of culpability helps Criminal Law to adequately hold the individual who commits the offense accountable. This time, the importance of the debate on the illegality of drugs is highlighted, considering that their consumption affects not only the individual who consumes it, as intended, but all of life in society.
