Abstract

In recent years there has been an exponential increase in the migration phenomenon. Specifically, the irregular migratory flow from the northern triangle zone (El Salvador, Guatemala and Honduras) has overflowed and Mexico as well as the United States have established a containment policy. Criminal law has been used as an instrument of repression against migrants. A punitive State was configured whose violence is justified by the principle of security. In this contribution we explore the function of the principle of security to found a Punitive State. The paradoxes that the security principle gives rise to are analyzed.
