Abstract

This article provides a preliminary reflection on the notion of “limits of the law”. After providing a critical reflection on the different ways in which legal scholarship deals with the law as an object of knowledge, the article outlines the contradictory nature of the idea of “legal determination,” and engages with philosophical reflections on the concept of “limit”. Finally, the article elaborates a concept of “limit” as a constitutive paradox of the law.

Past research at "Institut für Rechts- und Sozialphilosophie" da Universität des Saarlandes, in Saarbrücken, Germany. Visitant professor at Germany, Greece, Portugal, Argentina, Mexico, Colombia and Brazil. Developed with Niklas Luhmman the theory "Society Theory" and his work Systems Theory.
