Considering the lack of unanimity in the specialized doctrine, the absence of Brazilian labor laws regarding the characterization of sexual harassment in the workplace and the insufficient documentation and research for the development of concrete intervention strategies, this article aims to analyze the understanding of the Labor Justice regarding the characterization of sexual harassment in the workplace and how such body of the Judiciary applies the pertinent legislation to protect women against situations of sexual harassment at work. Therefore, bibliographic research and jurisprudential research are used as methods of approach; and the deductive and inductive methods are used as the methods of approach. It is concluded that despite the advances achieved by women through feminist movements and the growing female presence in the universe of work, the reality still demonstrates a situation of profound inequality between men and women, permeated by violence and discrimination, confirming the need for expansion of public policies that promote the empowerment and emancipation of women.
