The role of the right in ensuring a quality life when ageing:

the right to age dignified for black women in the peripheries

Abstract

Research bodies highlight the increase in the elderly population in Brazil. Linked to this fact, a series of intricacies accompany the aging process and the elderly population as a whole, due to the government's lack of preparation to deal with this issue. Aging is a process of natural biological wear and tear on the body that affects all beings. However, men and women in their diverse complexities, realities and regionalities do not age in the same way or with the same security and quality of life. In the peripheries, aging is different from other places. Some groups are privileged to the detriment of others. Peripheral black men and women are the groups attacked by the system, but they still have minorities within other minorities: the dignified aging of black women deprived of resources who reside in peripheral areas. Obstacles such as lack of representation, racism, prejudice and socially constructed discrimination are aggravating factors for the enjoyment of the rights and guarantees promulgated by the 1988 Constitution. A set of complex vulnerabilities prevails that prevent the realization of these rights in practice and the domination of capitalist structure and the dominant classes revealed the importance of promoting public policies that urgently need to be designed for peripheral realities from the birth of these people until old age so that there is in fact the engagement of this vulnerable portion of the population in all areas. The law has the duty to maintain the dignified aging of peripheral black women, however, the reality is contradictory and the result will be reflected in several sectors, causing a series of difficulties in accessing fundamental rights.
