DESCONSIDERAÇÃO DA PERSONALIDADE JURÍDICA NAS REDES EMPRESARIAIS

Abstract

This research aims to analyze the application of the Institute of Disregard of Legal Entity to Networks. To this end, it discusses the formation and structure of Networks, as well as their difference in relation to economic groups. Then, about the Institute of Disregard of Legal Entity, its theories and legislative prediction, especially that regarding Networks. Finally, it evaluates the judiciary's production on the Disregard of Legal Entity applied to Networks. From the perspective of deductive-dialectical methodology, based on the dialogue between bibliographical references, legislation and jurisprudence, the research concludes that there is no legislative provision on Networks, nor have the courts ruled on cases related to the subject, making it impossible to establish analysis between them and the institute under discussion; but, approaching what was observed from the research object, it was possible to infer that the application of the institute to the Networks, maintaining its current material bases, will depend on the relationship under discussion, which will determine the Disregard of Legal Entity theory and the consequent form of accountability of the partners of the legal entities in network.
