the tension between memory and acceleration in the formation of neoliberal legal subjectivity

The problem that directs this investigation is the following: how does the tension between memory and the acceleration of social time impact upon the formation of the legal subject in the neoliberal context? Grounded on a theoretical and conceptual study, and supported by documental and bibliographical analysis, the research is structured around the hypothesis that the formation of the neoliberal legal subjectivity may be brought to the fore by a crisis of historical time. The latter presents itself throught the prism of a critical theory of social acceleration, as put forth by Hartmut Rosa, and establishes a specific form of the legal subject that molds itself around neoliberal imperatives. The paper maps out the aforementioned tension and examines the constitutive elements of neoliberal legality. Finally, it concludes with a discussion of the neoliberal legal subjectivity.
