Abstract

The problem that directs this investigation is the following: how does the tension between memory and the acceleration of social time impact upon the formation of the legal subject in the neoliberal context? Grounded on a theoretical and conceptual study, and supported by documental and bibliographical analysis, the research is structured around the hypothesis that the formation of the neoliberal legal subjectivity may be brought to the fore by a crisis of historical time. The latter presents itself throught the prism of a critical theory of social acceleration, as put forth by Hartmut Rosa, and establishes a specific form of the legal subject that molds itself around neoliberal imperatives. The paper maps out the aforementioned tension and examines the constitutive elements of neoliberal legality. Finally, it concludes with a discussion of the neoliberal legal subjectivity.

Professor Permanente do Programa de Pós-Graduação em Direito da Faculdade Damas da Instrução Cristã (FADIC). Doutor em Direito pela Pontifícia Universidade Católica de Minas Gerais (PUC-MG, bolsista FAPEMIG, 2014). Mestre em Direito pela Pontifícia Universidade Católica de Minas Gerais (PUC-MG, 2010). Bacharel em Direito pela Universidade Federal de Juiz de Fora (UFJF, 2008), tendo realizado estudos de graduação no Colorado College (EUA, 2005) e da University of Westminster (Inglaterra, 2007). Foi bolsista PNPD/CAPES (2014-2015) no Programa de Pós-Graduação em Direito Agroambiental da Universidade Federal do Mato Grosso (UFMT). Editor Adjunto do periódico Cadernos de Relações Internacionais, do PPGD da Faculdade Damas. Revisor de periódicos nacionais e internacionais. Realiza pesquisas e publica regularmente nas seguintes áreas: Direito Internacional; História do Direito; História do Direito Internacional; pensamento pós-colonial/descolonial; Teoria da Constituição; Constitucionalismo Latino Americano. Tem experiências de docência nas disciplinas propedêuticas, Direito Internacional, Direitos Humanos e Direito Constitucional.
