The research questions to what extent the cosmopolitan view can contribute to the understanding of the phenomenon of the globalization of privacy in the 21st century and the need for regulation of the personal data protection right, in the context of surveillance capitalism. The general objective of the paper is to analyze the contributions of the cosmopolitan view in understanding the phenomenon of the globalization of privacy in the 21st century and the need for regulation of the personal data protection, in the context of surveillance capitalism. Specifically, it intends to explore the increase in surveillance practices by the State and private entities, re-signifying privacy in the 21st century in the context of surveillance capitalism; and to investigate the globalization of the personal data protection right and the need for global solutions, based on the contributions of the cosmopolitan view. The hermeneutic phenomenological method is adopted as the approach methodology, while the monographic method is used as the procedure methodology, with a bibliographic review about the theme. Thus, it concludes that legal cosmopolitanism can be a special element in the discussion of a global project for the personal data protection, or at least, about the need for international regulatory cooperation and coordination, considering the protection of the individual regardless of national conformations, based on a planetary solidarity and a humanism of interdependence, due to the challenges of surveillance capitalism.
