Abstract

This review article uses the deductive method, based on the theoretical framework of the principle of consideration and interests of Peter Singer. The possibility of depreciating the life of the elderly in front of a young person in an eventual lack of mechanical ventilators is assessed in the pandemic of COVID 19. Initially, the problem is contextualized. Then, it presents the legal and ethical normative context in which it brings the principle of the sacredness of life as an instrument to contain the malpractice of Biopower. In a third moment, addresses the evolutionary trajectory of Utilitarianism. Finally, after analyzing the principle of equal consideration and interests of Peter Singer in the light of otherness, in the case of insufficient ICU beds, in the Covid 19 pandemic and the decisioin between the life of an elderly person and the life of a young  person, it is concluded that the same is a pratical alternative to safeguard the fundamental right to life of the elderly, since it does not agree with the use of any discriminants in the treatment of interests between individuals.
