The possible influences of Weberian thought in the construction of Luhmann's systems theory are the objective of this article, written to try to demonstrate how one of the founders of Sociology was present in Luhmann's Sociology of Law. According to the existing literature, there is a tendency to answer that such influence is striking. However, the article seeks to demonstrate that the circular, recursive and cognitively open character of Luhmann's systems theory prevents it from asserting that there is a Weberian dominance in his thinking. To reach that conclusion, the study use the methodology of bibliographic review to compare the theory of both authors from a specific point: the sociology of law. The results show that Luhmann was influenced by several authors, from the most varied areas of knowledge, including Weber, without, however, affiliating his theory with one or the other
