Freedom of expression and regulation of moderation in online platforms

Concerns about freedom of expression are constantly expressed when the State acts within the scope of digital platforms. This article seeks to determine whether regulating moderation practiced by online platforms would be harmful to freedom of expression in Brazil. The hypothesis is that regulation would not be harmful to free speech in the country, since it would oblige platforms to treat their moderation procedures with transparency, so that society and the State could better investigate the details of the specific case and judge the correctness or incorrectness of the decision taken by the moderators. In the first section, freedom of expression will be analyzed in the Brazilian context, clarifying that existing legal norms and case law already restrict what type of expression is legally admissible in the country. The second section presents the concepts of moderation and digital platforms and the risks inherent in content moderation. The third section presents the arguments present in the literature on the regulation of moderation. It concludes with the verification of the hypothesis in light of the theoretical framework. The critical analytical methodology of bibliographic review was adopted.
