Abstract

Despite the institute's recent prediction in the Code of Civil Procedure of 2015,
procedural cooperation already exists in Comparative Law. However, considering the
guidelines of the Democratic Rule of Law, and the constitutional model of the process, it can
not be imported entirely from the Portuguese or German model. For this reason, a study of the
institute on a democratic constitutional bias is necessary, and the normative theory of coparticipation
appears to make this reading of article 6 of CPC / 2015. It is also necessary to
study cooperation as a principle or rule, as well as its relation to the principle of the adversary.
