THE DATING CONTRACT AS A LEGAL BUSINESS
an analysis of the contract signed by player Endrick and influencer Gabriely Miranda

The present work carries out a specific analysis of the dating contract based on the Brazilian case of football player Endrick with digital influencer Gabriely Miranda. Considering that this type of legal transaction can present itself in different forms and with the objective of creating, altering or extinguishing rights and/or duties, it is observed that it is a legal act that starts from the autonomy of the contracting parties who, as a rule, they must be capable, have as their object something lawful, possible, determined or determinable, the form of which is prescribed or not defense by law, according to art. 104 of the Civil Code of 2002, permeated by the principles of good faith and social function. In this sense, through bibliographical, theoretical-dogmatic research, with hypothetical-deductive reasoning in which theoretical and legislative analysis was carried out, the aim of this study is to understand the need to sign this type of contract, analyzing its legal effects and its distinction from stable union institute. In conclusive terms, there is a lack of legal relevance for this contractual modality given the lack of fulfillment of validity assumptions.
