THE INTERSECTION BETWEEN AUTONOMY AND EQUALITY BASED ON THE STATUS OF PERSONS WITH DISABILITIES

Abstract

This article is a study that deals with the relationship between the promotion and protection of autonomy and the objective of guaranteeing equal conditions with other people that the Statute of Persons with Disabilities, Law 13,146 of July 6, 2015, seeks to achieve. To this end, the methodology of bibliographic and legislative review is used, under the theoretical-dogmatic aspect, with hypothetical-deductive reasoning, in which, based on the advent of the Brazilian Inclusion Law, we seek to identify points of intersection between the concepts of autonomy and equality, understood, respectively, as self-government and is a configuration of the diversity bias within Biolaw. The objective was to demonstrate that within the microsystem of protection and promotion in which the Statute of Persons with Disabilities is configured, both concepts guide the applicability of the aforementioned normative diploma, therefore justifying the need for theoretical deepening in its understanding. The conclusion, finally, summarizes that the Statute does not solve the problem of discrimination against people with disabilities, but it presents itself as an important tool in promoting respect and implementation of autonomy and equality.
