THE SECOND WAVE OF COVID-19 IN THE STATE OF AMAZONAS: THE INEFFECTIVENESS OF JUDICIAL DECISIONS AS A COROLLARY OF STATE NEGLIGENCE

The object of the study is the relationship of ineffectiveness of judicial decisions rendered during the second wave of Covid-19 with state negligence. The analysis was carried out based on the following problematic perspective: did state action influence the ineffectiveness of judicial decisions that sought access to the Covid bed in the second wave of the pandemic? Therefore, the general objective of the research was to relate the conduct of the Government of the State of Amazonas during the Covid-19 pandemic with the ineffectiveness of judicial provision to the citizen under the second wave. The research was conducted through a methodology of literature review, qualitative and exploratory, with documentary analysis. The results indicated that, of the 187 people who filed lawsuits, only 71 had their decision fulfilled effectively. It was evidenced that the Judiciary was quick to deliver their decisions, however ineffective as to their due compliance, since interference of governments caused the Covid-19 crisis to be further aggravated in the state of Amazonia, the disparities already existing in the State. It is concluded that the ineffectiveness of the decisions is a consequence of the government deficiency in facing the pandemic, generating tragic consequences for the Amazonian people.
