THE SECOND WAVE OF COVID-19 IN THE STATE OF AMAZONAS: THE INEFFECTIVENESS OF JUDICIAL DECISIONS AS A COROLLARY OF STATE NEGLIGENCE

Abstract

The object of the study is the relationship of ineffectiveness of judicial decisions rendered during the second wave of Covid-19 with state negligence. The analysis was carried out based on the following problematic perspective: did state action influence the ineffectiveness of judicial decisions that sought access to the Covid bed in the second wave of the pandemic? Therefore, the general objective of the research was to relate the conduct of the Government of the State of Amazonas during the Covid-19 pandemic with the ineffectiveness of judicial provision to the citizen under the second wave. The research was conducted through a methodology of literature review, qualitative and exploratory, with documentary analysis. The results indicated that, of the 187 people who filed lawsuits, only 71 had their decision fulfilled effectively. It was evidenced that the Judiciary was quick to deliver their decisions, however ineffective as to their due compliance, since interference of governments caused the Covid-19 crisis to be further aggravated in the state of Amazonia, the disparities already existing in the State. It is concluded that the ineffectiveness of the decisions is a consequence of the government deficiency in facing the pandemic, generating tragic consequences for the Amazonian people.

Graduated in Law from the University of Vale do Rio dos Sinos (1996), Specialization in Integration and Mercosur from UFRGS (1999), Master in International Relations from the Federal University of Rio Grande do Sul (2004) and PhD in International Strategic Studies from UFRGS (2012). He is currently Advisor for Interinstitutional and International Affairs and permanent professor at the Graduate Program in Law and Society, in addition to being a member of the faculty of the International Relations Course at La Salle University. He is also a distinguished visiting professor at the Catholic University of Trujillo in Peru. He has experience in the area of International Relations and Law, with emphasis on the areas of International Relations Law, International Law, Regional Integration, Foreign Policy, in addition to the Internationalization of Higher Education. He also has experience in the area of Management of the Internationalization of Higher Education Institutions where he maintains scientific publications. Currently, he also coordinates the La Salle University community outreach project, which includes: support for immigrants.
