FOR A BRAZILIAN EXPERIMENTAL BIOETHICS

Abstract

This article seeks to analyze the possibility of a decolonial interpretation of experimental bioethics, whose hypothesis is the existence of a Brazilian bioethical theory, based on a decolonial interpretative bias. To this end, bibliographical research was used, in which texts on the history of bioethics, decolonial theory and regulations on the topic of research with human beings in the country were analyzed. Therefore, the historical news of bioethics was reconstructed, analyzing some relevant facts, such as the Holocaust, the creation of the Belmont Report and the adoption of CNS Resolutions 466/2012 and 510/2016. After that, decolonial theory was discussed, associating it with the historical fact of the discovery of the Americas and the political-economic-social imposition of Europe, a fact that was reflected in the production of local knowledge, in a way in which the political, social and cultural concealment of original peoples. Finally, the possibility of exit and interpretation was analyzed through the recognition of the plurality typical of decolonial authors, in a way that respects the diverse knowledge produced by the different people who live in Brazilian society. This is research with a legal-dogmatic aspect.
