Rule of law and rule by law: case analysis of foreign investment in Guangdong and Jiangsu (China)

Resumo

Por que províncias semelhantes têm estabilidade diferente em seus fluxos de investimento estrangeiro? A pesquisa compara as províncias de Guangdong e Jiangsu na República Popular da China e discute por que essas províncias de características semelhantes em infraestrutura e incentivos sob o modelo de abertura chinês diferem na estabilidade dos fluxos de Investimento Estrangeiro Direto (IED). A hipótese é que a agenda legal do investimento estrangeiro apresenta um ponto de equilíbrio mais próximo do rule of law em Guangdong do que em Jiangsu. A pesquisa desenvolve uma definição teórica do equilíbrio entre rule of law e rule by law na China e contrasta empiricamente -com mineração de texto e técnicas de processamento de linguagem natural- a agenda legal para investimentos nas duas províncias. Em conclusão, a hipótese é provada, mas com a descoberta emergente do fator cultural na província de Guangdong. É exatamente esse emergente que nos permite discutir o poder explicativo do rule of law sobre a estabilidade dos fluxos de IED.
