Poder y autonomía de las organizaciones internacionales: la OMPI en la gobernanza de los derechos de propiedad intelectual
Power and autonomy of international organizations: the WIPO in the governance of intellectual property rights

El artículo analiza el papel de la Organización Mundial de la Propiedad Intelectual (OMPI) en la estructuración del régimen internacional de propiedad intelectual, destacando cómo sus características particulares conferirían poder y autonomía sobre su constituency, los países miembros. Tendo como referencia a
la estructura analítica sugerida por Barnett y Finnemore (1999) sobre la autonomía de las organizaciones internacionales, se analizan las características organizativas y los mecanismos de gobernanza de la OMPI, fundamentalmente el papel de su Secretaría ejecutiva, la relación con el sector privado y su particular
mecanismo de financiación. La lectura de estos elementos y las actividades realizadas por la OMPI apuntan claramente a un nivel de poder y autonomía de la organización con respecto a los países que lo componen y un desprendimiento entre sus acciones y su mandato, lo que significaría un tipo de disfuncionalidad. Sin embargo, la conclusión a la que llegamos es que, en realidad, hay un cambio en la relación de dependencia de la OMPI y una especie de reconfiguración de su función internacional.
